iHerb (Shanghai) Company (“iHerb Shanghai”) Limited, an affiliate of iHerb, located in Shanghai, China and established in 2016 provides the “After-sales Support Services, Information Technology Services and Marketing Support Services” for iHerb LLC. The company currently has nearly 200 employees and its current address is in Changning District, Shanghai.

In addition to iHerb Shanghai, a new entity was recently created in the China (Shanghai) Pilot Free Trade Zone, in order to assist in further expanding iHerb’s market share of sales in China. This new entity, iHerb (Shanghai) E-commerce Co., Ltd, is also an affiliate of iHerb US and iHerb Shanghai and was created in 2022 for the purposes of serving as a marketplace to allow iHerb US to market and sell products to consumers in China. 

Job Summary

Associate Counsel will provide support to the Chief Legal Officer and provide strategic legal advice and act as a central point of contact for in-house legal in China. This role will provide legal support and advice in a number of areas, including but not limited to general business matters as well as legal/compliance issues pertaining to cross-border ecommerce, marketing, and retail sales of food supplements, health food, personal care and cosmetic products. This role should be familiar with applicable China labor laws and key laws/regulations pertaining business operations in China (ie: contractual obligations, e-commerce requirements, etc.) Since this is the first international legal counsel role, this position will require an individual who can work autonomously and flexibly, while working with a primarily US-based team.

Job Expectations

  • Coordinate and work seamlessly with US Legal/Compliance teams to help support the international business of the Company.
  • Participate in business initiatives and work with various stakeholders to provide solutions with the aim that legal issues do not become barriers.
  • Ability to seek external legal advice and guidance as appropriate depending on issues presented.
  • Provide support to the Company’s compliance and regulatory efforts.
  • Support Company’s efforts in meeting legal requirements to mitigate risk.
  • Provide strategic legal guidance to various departments in the company.  
  • Research/analyze industry-specific regulations to assist in implementation of compliance measures.  
  • Assist in evaluating the business impact of legislative, regulatory, and legal developments.
  • Participate in the development of the company’s policies and procedures. 
  • Negotiate and review a variety of contracts for the Company’s business initiatives.
  • Support the management and operations teams with ongoing and special initiatives.
  • Collaborate with Senior Director of Government and Public Affairs in building relationships with government and regulatory organizations in order to keep updated in relation to new and upcoming laws and regulations.  (e.g. Market Supervision Authority, customs matters, Labor Dispute Department).
  • Continuously updating workflow and cooperate with audit work.
  • Assist with any employment or labor law related matters.
  • Assist Chief Legal Officer in relation to international expansion matters and special projects as needed.  
  • Provide onsite legal support and guidance to the VP, Regional Business Operations (China)

Knowledge, Skills and Abilities

Required:

  • Licensed to practice law in the country of residence.
  • Experience in legal/compliance matters. 
  • Highly skilled negotiator and team player. 
  • Experienced in contract drafting and negotiating.
  • Litigation and regulatory experience.
  • Effective research and analytical skills.
  • Demonstrated ability to manage a heavy workload and complete transactions quickly and effectively.
  • Ability to work independently on projects, meet aggressive deadlines, and juggle multiple matters.
  • Ability to manage others with a team-oriented approach.
  • High degree of accuracy and attention to detail.
  • Excellent organization skills and ability to multitask.
  • Strong team player.

Equipment Knowledge:

  • Experience with Microsoft Office Suite (Word, Excel, PowerPoint).
  • Experience with Google Business Suite (Gmail, Drive, Docs, Sheets, Forms) preferred.

Experience Requirements:

  • Requires a minimum of seven (7) plus years of proven legal experience, both in a law firm and in-house. 
  • Experience in the food and beverage sector, food supplements, cosmetics, or OTC pharmaceuticals.
  • Must be fluent in English.

Education Requirements: 

  • University degree in Chinese Law

Judgment/Reasoning Ability:  

  • Able to identify, troubleshoot and resolve problems quickly using sound judgment, poise, and diplomacy.  
  • Ability to use judgment and reasoning skills, and determine when to escalate issues, as required, in a timely manner.

Physical Demands

The physical demands described here are representative of those that must be met by a Team Member to successfully perform the essential functions of this job. While performing the duties of this job, the Team Member is regularly required to talk and hear. The Team Member is frequently required to sit, walk, climb stairs, use hands and fingers, bend, stoop and reach with hands and arms.  Reaching above shoulder heights, below the waist or lifting as required to file documents or store materials throughout the workday. The Team Member may occasionally lift or move office products and supplies up to 25 pounds. Proper lifting techniques required.  Reasonable accommodations may be made to enable individuals with disabilities to perform the essential functions.
